Property Agreement

This Real Property Inspection Agreement to between- Atta-Boy Property Inspections (Edmonton) INC. and the customer. Whereas, the customer requests Atta-Boy Property Inspections (Edmonton) INC. to perform a Real Property Inspection Report at the following location on the date agreed. Whereas, Atta-Boy Property Inspections (Edmonton) INC. will provide a digital Real Property Inspection Report to the customer. Now Therefore, in consideration of the promises and covenants contained herein, the parties agree as follows.
1- Type of Inspection- The customer acknowledges that this report is an opinion based on visual and non-invasive inspection of the present condition of the property at the time of the inspection and not technically exhaustive or all encompassing.
2- Finding Presented- The customer acknowledges that Atta-Boy Property Inspections (Edmonton) INC. and any sub-contractors will not advise anyone to purchase the property or not. Atta-Boy Property Inspections (Edmonton) INC. shall only present their findings in relation to the inspection, so that the customer can make an informed decision. < br> 3- Warranty Or Guarantee- The customer acknowledges that Atta-Boy Property Inspections (Edmonton) INC. makes no warranty or guarantee, express or implied, as to the condition of any system or component, whether reported or not.
4- Standards Of Practice- The customer acknowledges that the inspection shall be preformed in accordance with the standards of practice, as set out by the American Association of Home Inspectors ASHI. The inspection shall not cover the inspection of any other structures not attached to the dwelling other than a garage or carport unless otherwise agreed by both parties.
5- Visual Inspection- The customer acknowledges that the property inspectors will be doing a visual inspection of the roof, flashing and chimney from the ground and not from the roof if weather conditions or height limits access.
6- Mold/Asbestos- The customer acknowledges that if they does not specifically ask for or select this service, then the inspection does not include the inspection of mold or asbestos. This is an optional service. The full lab report will be available to the client under a continuation/separate agreement.
7- Air Quality Testing - The customer acknowledges that if they does not specifically ask for or select this service, then an air quality test with 3 samples will not be conducted. This is an optional service. The full lab report will be available to the client under a continuation/separate agreement.
8 - Sewer Main Line Camera Inspection - The customer acknowledges that if they does not specifically ask for or select this service, then the inspection does not include a camera inspection of their main sewer line. This is an optional service. SewerGard protection is offered for a period of 90 days following the date of the inspection, or 22 days after closing, which ever comes later. If you received selected the additional Sewer Main Line Camera Inspection, this policy is extended to six months from the date of the inspection, or 22 days from closing, which ever comes later.
9- Heat Runs/Receptacles- The customer acknowledges that only a sampling of receptacles and heat runs will be inspected.
10- Thermal Imaging- The customer acknowledges that the thermal imaging camera is used as a diagnostic tool only complete thermal imaging is available under a separate agreement.
11- Structural Foundation- A) The customer acknowledges that the real property inspectors, and therefore Atta-Boy Property Inspections (Edmonton) INC. ability to inspect the structural and or foundation stability and condition of the property will be limited by the completion of a basement, grading and other factors limiting the inspectors to visually inspect only.
B) The customer also acknowledges that if there are cracks in the foundation and Atta-Boy Property Inspections (Edmonton) INC. and its sub-contractors have noted on their inspection report that it is their recommendation the customer contact a structural engineer to determine the repairs and the cost of the repairs that the limitation of a visual report will not all the inspectors and Atta-Boy Property Inspections (Edmonton) INC. , the ability to determine the extent of the problem.
12- Arbitration- The parties agree that if there are any claims between the customer and Atta-Boy Property Inspections (Edmonton) INC. and its sub-contractors hereto arising out of this agreement or service performed, that the claim shall be bound by the arbitrators determination and expressly waive any and all legal remedies.
13- Real Property Inspections Exclusions see appendix A.
14- Fees For Service- The fees for conducting the Real Property Inspection herein are in this invoice.
15- The Parties hereto have duly executed this Real Property Inspection Agreement as of the effective date above in this invoice. In addition, all parties understand and accept all terms of this agreement and are bound by the terms herein.
Appendix A The customer acknowledges that the Real Property Inspection does not cover, nor includes the investigation, evaluation, inspection or analysis of any of the items listed below. Any concealed or cover up item, Bylaw Compliance, Code Compliance, Central air conditioning when temperature is less 15 degrees C, Earthquake potential, Electromagnetic field detection, Encroachments, Fire safety, Flood potential, Indoor air quality, Lawn sprinklers, Lead/lead paint detection, Pilings and sub-grade foundation review and analysis, City private water systems, Radon detection, Soil and geological analysis, Solar equipment, Spas, hot tubs and their systems, Structural engineering analysis, Swimming pools and their systems, Title search, Underground fuel tanks, Underground water or sewer lines, Urea formaldehyde detection, Water portability bacteria, chemical, or toxin analysis, Well capacity analysis, WETT Inspections, Wood destroying insects and organisms, Gates and fencing.

Refund Policy

In the event you, the client, request us to change the booking date & time of the inspection, we will charge a $75 rebooking fee. If you need to cancel the inspection completely, we can credit your account the full amount and allow you to rebook the inspection within a 1 year period. The rebooking fee of $75 still applies. For refund requests, we charge a $250 cancellation fee.

Your Property Inspector has an affiliation with Residential Warranty Services (RWS), a third party service provider, in order to offer you additional value-added services including a complimentary RecallChek to help determine if the inspected property has any potentially dangerous recalled appliances, as well as a complimentary Home Warranty. By entering into this agreement you (a) authorize your inspector to provide your contact information (including telephone number) to RWS and/or its affiliate, (b) waive and release any restrictions that may prevent RWS and/or its affiliate from contacting you (including by telephone using automated dialing technology), and (c) authorize RWS and/or its affiliate to contact you regarding home services.
